Terms of Use for GreenIoTAI

1. Who may use GreenIoTAI

GreenIoTAI is offered for personal, non-commercial use only.

You may use the Service only if you are legally permitted to enter into this agreement under applicable law. If you are under the age at which you can legally agree to these Terms in your jurisdiction, your parent or legal guardian must review and agree to these Terms on your behalf and may need to supervise your use of the Service as required by law.

By using the Service, you represent that you are legally permitted to do so, or that your parent or legal guardian has agreed to these Terms for you.

We may refuse access to the Service, or suspend or terminate access, if we reasonably believe use of the Service is unlawful, unauthorized, or inconsistent with these Terms.

2. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may provide notice by updating the date above, posting notice through the Service, or contacting you through the email associated with your account.

Your continued use of the Service after revised Terms become effective means you accept the updated Terms.

3. Your account

Some features of GreenIoTAI may require an account.

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.

You may not:

• share your account with another person
• allow anyone else to access the Service through your account
• transfer, sell, rent, or sublicense your account
• create an account using false or misleading information
• impersonate another person or misrepresent your identity

If you suspect unauthorized access to your account, contact GreenIoTAI at support@greeniotai.ir as soon as possible.

4. Personal use only

Your right to use GreenIoTAI is personal to you. The Service is licensed, not sold, and only for your own individual learning use.

You may not use the Service for resale, classroom distribution, enterprise deployment, bureau services, commercial tutoring operations, content extraction, or any other commercial purpose unless we expressly allow it in writing.

5. Free trials, subscriptions, billing, cancellation, and refunds

GreenIoTAI may offer free trials and paid subscriptions.

Free trials: If a free trial is offered, it may automatically convert into a paid subscription unless you cancel before the trial ends. The trial terms shown at sign-up in the Apple App Store or Google Play will control.

Subscriptions: Paid subscriptions may renew automatically unless canceled before the renewal date. Pricing, billing intervals, and included features may vary by plan, platform, location, taxes, promotions, and store policies.

Store billing: If you subscribe through Apple or Google Play, your purchase is billed and managed by that platform, not directly by GreenIoTAI. You are responsible for managing your subscription through the relevant store account, including auto-renewal, cancellations, payment method updates, and billing history.

Cancellation: If you cancel, your subscription will generally remain active until the end of the current billing period or free trial period, then expire without renewal. Deleting the app does not cancel a subscription.

Refunds: For purchases made through the Apple App Store or Google Play, refund requests are generally handled by the store through which you purchased. Except where required by law, GreenIoTAI does not provide direct refunds for store-billed purchases.

Changes to plans or pricing: We may change subscription features, plan structure, or pricing at any time. Where purchases are handled through an app store, notice, consent, renewal, and cancellation will be governed by that store's applicable rules and by law.

6. License to use the Service

Subject to these Terms, GreenIoTAI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.

You may not:

• copy, reproduce, distribute, republish, sell, lease, or commercially exploit the Service
• modify, adapt, translate, or create derivative works based on the Service
• reverse engineer, decompile, disassemble, or attempt to discover source code, models, systems, or underlying components, except where non-waivable law expressly permits it
• scrape, harvest, index, or extract content or data from the Service
• bypass security measures, rate limits, or access restrictions
• interfere with or disrupt the Service or connected systems
• use the Service to build, benchmark, or train a competing product or service

All rights not expressly granted are reserved by GreenIoTAI and its licensors.

7. Educational purpose only

GreenIoTAI is designed to support vocabulary learning and related educational activities. The Service is provided for general educational and informational purposes only.

We do not promise any specific learning result, exam result, academic outcome, immigration outcome, professional outcome, or fluency level.

8. User content

You may be able to create, save, or submit certain content through the Service, including custom word lists, saved vocabulary items, answers, or other learning-related inputs ("User Content").

You retain ownership of your User Content. However, you grant GreenIoTAI a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, transmit, and use your User Content only as necessary to:

• provide and operate the Service
• maintain your account, lists, and learning progress
• respond to your actions and requests
• troubleshoot, prevent abuse, secure the Service, and provide support
• comply with legal obligations and enforce these Terms

You represent and warrant that:

• you have all rights necessary to submit your User Content
• your User Content does not violate any law or third-party right
• your User Content does not include malware, harmful code, or unauthorized material

We may remove, restrict, or disable access to User Content if we reasonably believe it violates these Terms, creates risk, or is otherwise inappropriate for the Service.

9. AI-powered features

Some GreenIoTAI features may use artificial intelligence to provide feedback, recommendations, explanations, corrections, pronunciation guidance, or other outputs.

By using AI-powered features, you understand and agree that:

• AI-generated outputs may be incomplete, inaccurate, delayed, inconsistent, or inappropriate
• AI feedback is provided for general educational use only
• you are solely responsible for reviewing and deciding whether to rely on any AI-generated output
• GreenIoTAI does not guarantee that AI output is correct, suitable, or fit for your particular purpose
• similar prompts may produce similar outputs for different users

If you use voice-based features, you authorize GreenIoTAI to process your speech input solely as needed to provide the requested feature and operate the Service.

10. Acceptable use

You agree not to use GreenIoTAI to:

• break the law or encourage unlawful conduct
• infringe intellectual property, privacy, publicity, or other rights
• harass, threaten, abuse, or harm another person
• upload malicious code or interfere with the integrity or security of the Service
• gain unauthorized access to accounts, systems, or data
• use bots, scripts, crawlers, or automated tools to access or extract from the Service
• abuse free trials, promotions, discounts, or referral features
• circumvent usage limits, content protections, or access controls
• reverse engineer or probe the Service or its technical systems
• use the Service in a way that could damage, disable, overload, or impair it
• use the Service for cheating, fraud, impersonation, or deceptive activity

We may investigate suspected misuse and cooperate with law enforcement or other authorities where legally required or appropriate.

11. GreenIoTAI content and intellectual property

The Service and all content made available by GreenIoTAI, including software, interfaces, lessons, text, graphics, audio, designs, branding, logos, and other materials ("GreenIoTAI Content"), are owned by or licensed to GreenIoTAI and protected by applicable intellectual property laws.

Except as expressly allowed by these Terms, you may not use GreenIoTAI Content without prior written permission.

The names, logos, and branding associated with GreenIoTAI may not be copied or used in a way that suggests sponsorship, affiliation, or endorsement without permission.

12. Feedback

If you send GreenIoTAI any ideas, suggestions, recommendations, or feedback, you agree that we may use them without restriction and without compensation or obligation to you.

13. Third-party services

The Service may include links to, rely on, or interoperate with third-party services, including app stores, hosting services, payment systems, analytics tools, or other platforms.

GreenIoTAI is not responsible for third-party services, their availability, content, conduct, terms, or privacy practices. Your use of third-party services is governed by their own terms and policies.

14. Service availability

We may add, remove, change, suspend, or discontinue any feature, content, lesson, streak, saved item, or part of the Service at any time, with or without notice.

We do not guarantee that the Service will always be available, uninterrupted, secure, accurate, or error-free.

Temporary outages, delays, bugs, maintenance periods, security events, and technical issues may occur.

15. Suspension and termination

You may stop using the Service at any time.

We may suspend, restrict, disable, or terminate your access to the Service, in whole or in part, at any time and without liability, if we reasonably believe:

• you violated these Terms
• your use creates legal, security, operational, or reputational risk
• your conduct may harm other users, GreenIoTAI, or third parties
• required fees were not paid
• we are required to do so by law
• we decide to stop offering the Service or part of it

If your account is terminated, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including sections relating to ownership, disclaimers, limitations of liability, indemnity, governing law, and dispute resolution.

16. Privacy

Your use of GreenIoTAI is also governed by our Privacy Policy. Please read it carefully. By using the Service, you acknowledge that GreenIoTAI may collect, use, and disclose information as described in the Privacy Policy.

17. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.

GreenIoTAI makes no representations or warranties, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, or availability.

Without limiting the above, GreenIoTAI does not guarantee that:

• the Service will be uninterrupted, secure, or error-free
• any lesson, review schedule, AI response, pronunciation analysis, dictionary entry, or learning recommendation will be accurate or complete
• the Service will meet your expectations or achieve any intended result
• defects will be corrected
• the Service will be compatible with every device, operating system, browser, or network
• data loss, downtime, or other failures will never occur

Any reliance you place on the Service or on any output from the Service is at your own risk.

Nothing in these Terms excludes any rights or warranties that cannot be excluded under applicable law.

18. Limitation of liability

To the maximum extent permitted by law, GreenIoTAI and its licensors, service providers, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, savings, goodwill, data, content, or business opportunity, arising out of or relating to the Service or these Terms.

To the maximum extent permitted by law, the total aggregate liability of GreenIoTAI for any and all claims arising out of or relating to the Service or these Terms will not exceed:

• the total amount you paid for the Service in the 12 months before the event giving rise to the claim, or
• if you paid nothing, CAD $50,

whichever is greater only if required by applicable law.

You agree that any claim arising out of or relating to the Service must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, except where such a restriction is prohibited by law.

Some jurisdictions do not allow certain limitations or exclusions of liability, so some parts of this section may not apply to you.

19. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless GreenIoTAI and its affiliates, service providers, contractors, licensors, and representatives from and against any claims, liabilities, damages, losses, judgments, awards, costs, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Service
• your User Content
• your violation of these Terms
• your violation of any law or third-party right

20. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict of law principles.

Before filing a legal claim, you and GreenIoTAI agree to first try to resolve the dispute informally by contacting the other party. You may contact GreenIoTAI at support@greeniotai.ir. If a dispute is not resolved within 30 days after notice, either party may bring the claim in the courts located in British Columbia, Canada, unless applicable consumer law requires otherwise.

To the extent permitted by law, you agree that disputes will be resolved only on an individual basis and not in a class, consolidated, or representative action.

If the law where you live gives you mandatory consumer rights, those rights continue to apply.

21. Export and compliance

You may not use the Service in violation of applicable sanctions, export controls, trade restrictions, or other laws. By using the Service, you represent that your access and use comply with applicable law.

22. Apple App Store additional terms

If you downloaded the GreenIoTAI app from the Apple App Store, the following additional terms apply:

• These Terms are between you and GreenIoTAI, not Apple.
• Apple is not responsible for the Service or its content.
• Your license to use the iOS app is limited to a non-transferable license to use the app on Apple-branded products you own or control, subject to applicable App Store usage rules.
• Apple has no obligation to provide maintenance or support services for the app.
• To the extent any warranty cannot be disclaimed under law, Apple's responsibility is limited to any refund rights it is required to provide.
• GreenIoTAI, not Apple, is responsible for addressing claims relating to the app, including product liability, legal compliance, and intellectual property claims, to the extent required by law.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

23. Google Play additional terms

If you downloaded the GreenIoTAI app from Google Play, your use of the app may also be subject to Google Play's applicable terms, policies, and rules. Google is not responsible for support or maintenance of the Service except as required by law.

24. Entire agreement

These Terms, together with the Privacy Policy and any additional terms that apply to specific features or promotions, form the entire agreement between you and GreenIoTAI regarding the Service and supersede prior agreements relating to the same subject matter.

25. Severability and waiver

If any provision of these Terms is found unenforceable, the remainder will remain in full force to the maximum extent permitted by law.

If GreenIoTAI does not enforce a provision of these Terms, that will not be considered a waiver of that provision or of any other right.

26. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. GreenIoTAI may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, or operation of law.
